Terms of Service
These Terms of Service govern your use of the NikkiMail application, website and related services.
NikkiMail is operated by AB15 Media and Technology Limited, a company registered in Scotland with company number SC902666. Its registered office is 38 West Craigbank Crescent, Aberdeen AB15 9AU, United Kingdom. In these Terms, “NikkiMail”, “we”, “us” or “our” means AB15 Media and Technology Limited.
1. Acceptance of these Terms
You agree to these Terms when you select “I agree”, connect a Google Account, purchase a subscription or continue using NikkiMail after being presented with these Terms.
If you do not agree, you must not connect an account or use NikkiMail.
You must be legally capable of agreeing to these Terms. If you use NikkiMail for or on behalf of another person or organisation, you confirm that you have authority to connect the relevant account and agree to these Terms on their behalf.
2. What NikkiMail provides
NikkiMail is an email cleanup utility for supported Google accounts. Depending on the permissions you grant and the features you select, NikkiMail can:
- analyse Gmail metadata to identify repeat senders, historical buildup and large messages;
- estimate the number and size of potential cleanup opportunities;
- move matching messages to Gmail Trash;
- send supported unsubscribe requests;
- create or remove Gmail filters intended to send future mail from selected senders to Trash;
- display selected messages using a text-only preview;
- inspect Gmail Trash and restore supported messages; and
- permanently delete messages from Gmail Trash when explicitly instructed.
NikkiMail is a tool that follows user instructions. It does not determine whether an email is important, whether it should be retained, or whether deleting it is in your interests.
NikkiMail is not an email backup, archive, records-management or legal-retention service.
3. Your instructions and confirmations
You control whether a mailbox action is performed. Each confirmation submitted through NikkiMail is an instruction from you authorising the app to carry out the action described in the confirmation screen.
Before confirming an action, you must check:
- the connected Google Account;
- the sender, message or mailbox area concerned;
- whether the displayed count is an estimate or a current matching count;
- whether the action moves mail to Trash, affects future mail, sends an unsubscribe request or permanently deletes mail; and
- any warning displayed by NikkiMail.
NikkiMail may rely on your confirmation without separately investigating whether the affected emails should be retained, whether the sender is important to you, or whether you have complied with any backup or record-retention obligation.
You are solely responsible for the choices you confirm and for the resulting effect on your mailbox.
If any account, sender, message count, selection or likely result appears unexpected, you must cancel the action.
4. Access by other people
You must keep your device, Apple Account, Google Account, passwords, verification codes, recovery information and active NikkiMail session secure.
You must not disclose credentials or grant access to anyone whom you do not intend to authorise to use your mailbox.
For these Terms, an “Authorised User” means anyone to whom you:
- disclose account credentials, authentication information or verification codes;
- give access to an unlocked device containing an active NikkiMail or Google session;
- permit to use your Google Account or NikkiMail session; or
- otherwise enable to submit actions through your connected account.
You are solely responsible for supervising every Authorised User and for all mailbox actions submitted by an Authorised User. Such actions will be treated as if submitted by you personally.
If you suspect access by someone you did not authorise, you must promptly secure the affected accounts, sign out, revoke NikkiMail’s Google access where appropriate and contact us.
5. Consequences of mailbox actions
Moving messages to Trash
When you confirm a cleanup, NikkiMail may move the messages matching the confirmed selection to Gmail Trash.
Gmail automatically permanently deletes messages after 30 days in Trash. Messages can also be permanently deleted sooner if you or another authorised user empties Trash. Messages in Gmail Trash remain subject to Google’s retention and deletion rules. You are responsible for reviewing Trash and restoring anything you wish to keep before Google or an authorised user permanently deletes it.
Blocking future mail
If you choose to stop future mail and a supported unsubscribe method is not completed, NikkiMail may create a Gmail filter that sends future messages matching the selected sender to Trash.
A filter may affect important, transactional or otherwise wanted messages sent from the same address. Sender addresses and sending practices can also change, so blocking is not guaranteed to stop every future message.
Filters are created within Gmail. They may remain active after you sign out, disconnect NikkiMail or delete the NikkiMail application. You are responsible for reviewing and removing unwanted filters through NikkiMail or Gmail.
Unsubscribe requests
Where a message provides a supported standards-based method, NikkiMail may send an unsubscribe request to the sender’s endpoint.
The sender or mailing-list operator controls that endpoint. NikkiMail cannot guarantee that the request will be accepted, processed promptly, applied to every mailing list or honoured in the future.
Permanent deletion
When you explicitly confirm permanent deletion, NikkiMail may permanently delete the messages identified in Gmail Trash at execution.
Permanent deletion cannot be undone by NikkiMail. Deleted messages may not be recoverable from NikkiMail, Gmail, Google support, a device backup or any other source.
6. Mailbox changes and refreshed selections
Mailboxes can change at any time. New messages can arrive, messages can be moved or restored, and labels or settings can be changed by you, Google, another mail application or an Authorised User.
NikkiMail may refresh a selection immediately before performing a destructive action. The refreshed result may differ from an earlier estimate or preview.
You must review the final confirmation and must not proceed if its scope is unexpected.
7. Backups, retention and legal obligations
Before confirming a cleanup or permanent deletion, you are responsible for retaining, exporting or backing up any email that you may need.
You are solely responsible for identifying and complying with any legal, regulatory, contractual, employment, tax, accounting, audit, litigation-hold, safeguarding or other record-retention obligation that applies to your mailbox.
You must not use NikkiMail to destroy, conceal or obstruct access to material that must lawfully be preserved.
NikkiMail is intended principally for personal and household mailbox cleanup. You must not rely on it as a records-management system for a regulated, professional or business mailbox.
8. Estimates and discovery results
NikkiMail uses Gmail search results, metadata, sampling and estimation techniques to identify cleanup opportunities efficiently.
Initial message counts, storage amounts, potential savings, sender groupings and similar figures may be estimates. They are not guarantees.
NikkiMail does not guarantee that it will:
- find every unwanted email or sender;
- identify every message associated with a person or organisation;
- classify every email correctly;
- calculate the exact storage Google will recover;
- detect every variation of a sender’s address; or
- produce the same result as Gmail’s own interface or storage calculations.
9. Google, Apple and third party services
NikkiMail depends on services and interfaces supplied by Google, Apple and other third parties. Your use of those services remains subject to their terms and policies.
NikkiMail is not affiliated with or endorsed by Google.
Third party services may change their features, APIs, permissions, policies, availability or security requirements. Those changes may affect NikkiMail’s features or require us to modify, suspend or discontinue part of the service.
NikkiMail does not control and is not responsible for a third party’s processing of an unsubscribe request, delivery of future mail, mailbox retention rules, account security decision, payment service or system availability.
10. Purchases and subscriptions
NikkiMail may offer limited free use and a paid NikkiMail Pro subscription.
The price, billing period, trial or introductory offer, renewal terms and included features shown in Apple’s purchase interface apply to your purchase.
Subscriptions are processed by Apple and renew automatically unless cancelled in accordance with Apple’s subscription terms. You can manage or cancel a subscription through your Apple Account subscription settings.
Apple determines eligibility for introductory offers and processes applicable refunds in accordance with its policies and applicable law.
11. Licence and acceptable use
Subject to these Terms and applicable App Store terms, NikkiMail grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the application for its intended purpose.
You must not:
- access or connect an account without authority;
- use NikkiMail unlawfully or to destroy information unlawfully;
- bypass security, subscription or usage controls;
- probe, disrupt or interfere with NikkiMail or its connected services;
- reverse engineer the application except where applicable law expressly permits it;
- misrepresent your authority to use an account; or
- use NikkiMail in a way that infringes another person’s rights.
12. Availability, updates and suspension
NikkiMail may be changed, updated, restricted, suspended or discontinued where reasonably necessary for security, maintenance, legal compliance, third party requirements or product development.
We do not guarantee uninterrupted, continuous or error-free availability.
We may suspend or terminate access where we reasonably believe that an account is being used unlawfully, without authority, in breach of these Terms or in a manner that risks harm to NikkiMail, its users or a third party.
13. Disclaimer
To the fullest extent permitted by applicable law, NikkiMail is provided on an “as available” basis.
NikkiMail does not guarantee that every cleanup opportunity will be identified, every estimate will be exact, every unsubscribe request will succeed, every filter will match only messages you regard as unwanted, or every service supplied by Google, Apple or another third party will remain available.
You must use your own judgement before confirming any mailbox action.
14. Responsibility and limitation of liability
You accept and are solely responsible for the results and consequences of:
- actions confirmed by you;
- actions submitted by an Authorised User;
- access you give to your device, accounts or active NikkiMail session;
- your failure to review an account, selection, count, warning or action before confirming;
- your failure to retain or back up messages that you may need;
- your failure to comply with an applicable retention obligation;
- Gmail filters or unsubscribe requests that affect future mail;
- messages being permanently deleted from Trash; and
- using NikkiMail for a purpose for which it was not designed.
To the fullest extent permitted by applicable law, NikkiMail is not responsible for loss of email, loss of data, missed or redirected future mail, inability to restore or recover messages, unsuccessful unsubscribe requests, loss resulting from a third party service, or any other consequence arising from the matters listed above.
NikkiMail is not responsible for indirect or consequential loss, loss of business, revenue, profit, opportunity, goodwill or anticipated savings resulting from use of NikkiMail to the fullest extent that such liability can lawfully be excluded.
Nothing in these Terms excludes or limits any right, remedy or liability that cannot lawfully be excluded or limited under applicable consumer protection law, including the Consumer Rights Act 2015.
15. Ending your use of NikkiMail
You may stop using NikkiMail at any time.
Signing out ends the current NikkiMail session but does not necessarily revoke Google authorisation, delete NikkiMail’s local cache or remove filters already created in Gmail.
“Disconnect Google & Delete NikkiMail Data” deletes NikkiMail’s local Gmail-derived data for the connected account, signs you out and attempts to revoke NikkiMail’s Google authorisation. It does not delete Gmail messages or automatically remove Gmail filters already created in the Google Account.
Deleting the application may remove its ordinary application storage, although certain limited information stored through Apple’s Keychain services may persist as described in the Privacy Policy.
16. Apple App Store
Your licence to use the iOS application is also subject to the applicable Apple App Store terms and end-user licence terms.
Apple is responsible for App Store distribution and payment processing. NikkiMail, rather than Apple, is responsible for providing support for the NikkiMail service, subject to these Terms.
17. Changes to these Terms
We may update these Terms when NikkiMail, applicable law or third party requirements change.
The revised Terms will identify a new effective date. Where a change is material, we will provide notice and request renewed agreement before the revised Terms apply where required.
Your continued use after the effective date of a properly notified revision constitutes acceptance where applicable law permits.
18. Governing law and disputes
These Terms are governed by the laws of Scotland.
If you are a consumer, this choice does not deprive you of any mandatory protection provided by the law of the country in which you live. You may bring proceedings in any court available to you under applicable consumer law.
Before starting formal proceedings, you and NikkiMail should first attempt to resolve the matter by contacting the other party and allowing a reasonable opportunity to respond.
19. General provisions
If a court finds part of these Terms invalid or unenforceable, the remaining provisions will continue to apply.
A delay in enforcing these Terms does not waive the right to enforce them later.
You may not transfer your rights under these Terms to another person without our agreement. We may transfer our rights and obligations as part of a reorganisation, financing or transfer of the NikkiMail business, provided that doing so does not reduce your mandatory consumer rights.
